1. Acceptance of Terms

By accessing or using SMSTunnel ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

SMSTunnel is an SMS gateway service that allows you to send SMS messages through your own Android phone using our API and applications. The Service includes:

  • Android application for SMS sending
  • REST API for integration
  • WordPress plugins
  • Web dashboard for management

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree NOT to use the Service to:

  • Send spam or unsolicited messages
  • Send illegal, harmful, or fraudulent content
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit viruses or malicious code
  • Attempt to gain unauthorized access to systems
  • Send messages to numbers without proper consent

Violation of these terms may result in immediate account termination without refund.

5. SMS Regulations

You are responsible for complying with all applicable SMS regulations in your jurisdiction, including but not limited to:

  • Obtaining proper consent before sending messages
  • Providing opt-out mechanisms where required
  • Following carrier guidelines and restrictions
  • Respecting time-of-day sending restrictions

6. Pricing and Payment

Subscription fees are billed in advance on a monthly or yearly basis. All payments are processed through Stripe and are non-refundable except as required by law.

  • Prices are in USD unless otherwise stated
  • We may change prices with 30 days notice
  • Failed payments may result in service suspension

7. Service Availability

We strive to maintain high availability but do not guarantee 100% uptime. The Service depends on:

  • Your phone's internet connectivity
  • Your carrier's SMS service availability
  • Our server infrastructure

We are not liable for SMS delivery failures caused by factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, SMSTunnel and NARBOWEB SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

You may cancel your account at any time through the dashboard or by contacting support. We may terminate your account if:

  • You violate these Terms of Service
  • You engage in fraudulent activity
  • Your payment method fails repeatedly
  • We are required to do so by law

10. Intellectual Property

The Service, including its design, code, and content, is owned by NARBOWEB SRL. You may not copy, modify, or distribute any part of the Service without our written permission.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of Romania. Any disputes shall be resolved in the courts of Romania.
